Other Prosecuting Agencies
You may find yourself subject to a criminal charge under Commonwealth legislation. The Commonwealth Director of Public Prosecutions also prosecute offences on behalf of other Commonwealth Departments.
These matters are generally heard and determined by State and Territory Courts
The Sentencing Scheme in relation to Commonwealth Offences is generally different to the State Sentencing Scheme.
The Courts have the following options when imposing a sentence for an offence under Commonwealth law:
- Dismiss the Charge;
- Bond without conviction;
- Bond with conviction;
- Fine with conviction;
- State and Territory Community Correction Order/similar with conviction
- Imprisonment with conviction
