Commonwealth Offences

You may find yourself subject to a criminal charge under Commonwealth legislation. The Commonwealth Director of Public Prosecutions also prosecute offences on behalf of other Commonwealth Departments.

These matters are generally heard and determined by State and Territory Courts

The Sentencing Scheme in relation to Commonwealth Offences is generally different to the State Sentencing Scheme.

The Courts have the following options when imposing a Sentence for an offence under Commonwealth law:

Dismiss the Charge;
Bond without conviction;
Bond with conviction;
Fine with conviction;
State and Territory Community Correction Order/similar with conviction
Imprisonment with conviction

Council Offences

Council offences are prosecuted under the relevant Council regulations and are usually heard at the Magistrates’ Court. Penalties associated with Council offences are usually penalties determined by the regulated provision.

What am I most likely going to be sentenced with?

This depends on several factors. Firstly, the nature of the allegation. Secondly, whether you have been to court previously. Finally, if you have any criminal history. These factors will be considered by the Court in their sentencing.

Will I get a Conviction or a Non-Conviction?

The Court will look at the seriousness of the offending, whether or not it is going to affect you in the workplace or with social standing and whether you have any prior criminal history. These factors will be considered by the Court in the sentencing.
